A case that could redefine the Governor’s powers (and perhaps his Presidential ambitions) had oral arguments today before Minnesota’s Supreme Court.
The case filed by three low-income people pits the Governor vs the Legislature on who can make the state’s budget. It’s an arcane power called “unallotment” that the Governor has to use in budget emergencies. Last year Governor Tim Pawlenty used that power to reshape the state’s entire budget including pulling money from state nutrition program for the poor. A lower court has already ruled against the Governor. If the MN Supreme Court upholds the ruling, the state of Minnesota will be facing a huge deficit as funding must be restored to the many programs the Governor cut.
